DIYK9® TERMS AND CONDITIONS

Last Updated: Version: 2026.09.29

1. AGREEMENT TO THESE TERMS

These Terms and Conditions (the "Terms") govern your access to and use of DIYK9.com and any related website, course platform, community, membership, digital product, video, training material, support feature, or other online product or service offered by DIYK9®, LLC ("DIYK9®," "we," "us," or "our"). By purchasing, accessing, creating an account for, or using any DIYK9® product or service, you agree to these Terms and our Privacy Policy, together with any product-specific terms presented to you at purchase or before access.

DIYK9®, LLC is a Florida limited liability company. DIYK9® is affiliated with American Standard Dog Training, LLC, also a Florida limited liability company ("American Standard Dog Training"). American Standard Dog Training is widely used in connection with our social media, educational content, marketing, and dog-training activities and may direct users to DIYK9® products and services. Unless expressly stated otherwise for a particular product or service, purchases of DIYK9® courses, memberships, digital products, and online services are transactions solely with DIYK9®, LLC.

The appearance of American Standard Dog Training, Garret Wing, or any affiliated brand, trainer, social media account, representative, or contractor in advertising, social media content, Training Materials, or promotional or educational content does not, by itself, make that person or affiliated entity a separate contracting party to your purchase from DIYK9®, LLC.

For purposes of these Terms, "Released Parties" means DIYK9®, LLC; American Standard Dog Training, LLC; their affiliated brands and entities; and their respective owners, members, managers, officers, directors, employees, trainers, coaches, contractors, agents, representatives, moderators, administrators, successors, and assigns.

2. ELIGIBILITY; AGE REQUIREMENTS; MINORS

You must be at least eighteen (18) years old and legally capable of entering into a binding agreement to purchase a DIYK9® product, create or operate a DIYK9® account, accept these Terms, participate in a DIYK9® community, submit content, communicate privately with trainers or administrators, or request individualized training support.

A parent or legal guardian may permit a minor to observe or participate in age-appropriate dog-training activities using appropriate DIYK9® Training Materials outside the DIYK9® community, but only when the adult has accepted these Terms and directly supervises the minor. The adult remains responsible for the minor's conduct, safety, compliance with these Terms, and use of the Training Materials. A minor may not independently access or operate the adult's account.

Minors may not independently handle or train a dog displaying known or suspected aggression, biting, redirected aggression, serious reactivity, resource guarding, dangerous prey drive, or other behavior that creates a material risk of injury. DIYK9® may designate additional courses, lessons, exercises, tools, or activities as adult-only. A minor may never be placed in a training situation involving a dog the minor cannot safely and physically control.

DIYK9® community access and participation are strictly limited to individuals eighteen (18) years of age or older. Persons under 18 may not create or operate a community account, post or comment in the community, send or receive direct messages, upload training content through an account they operate, submit questions, participate in community-based support, or communicate privately with DIYK9® trainers, coaches, moderators, administrators, or other community members through the platform. If DIYK9® learns that a community account is being used by a person under 18, DIYK9® may immediately restrict or terminate community access and take any additional steps required by applicable law and our Privacy Policy.

3. EDUCATIONAL PURPOSE AND SCOPE OF TRAINING MATERIALS

DIYK9® provides educational dog-training information, demonstrations, courses, videos, memberships, communities, question-and-answer sessions, written materials, and related resources (collectively, the "Training Materials"). Unless DIYK9® or an affiliated entity has expressly entered into a separate written agreement with you for an in-person service, the Training Materials are educational in nature and are not a substitute for an in-person evaluation of you, your dog, your environment, or your specific circumstances.

Dogs are living animals whose behavior cannot be predicted or controlled with certainty. No video, written instruction, online communication, demonstration, course, community response, or other Training Material can account for every dog, handler, environment, medical condition, behavioral history, distraction, trigger, or circumstance. You are responsible for determining whether any exercise, technique, tool, or recommendation is appropriate and safe for you and your dog.

4. ASSUMPTION OF INHERENT RISKS OF DOG TRAINING

You acknowledge and understand that owning, handling, training, exercising, restraining, correcting, transporting, socializing, or otherwise interacting with a dog involves inherent and unavoidable risks. These risks exist regardless of a dog's breed, size, age, training history, temperament, prior behavior, or apparent level of obedience and may arise even when training methods are performed correctly.

Risks include, without limitation:

  • Dog bites, attacks, redirected aggression, lunging, snapping, scratching, jumping, mounting, resource guarding, or other unpredictable behavior;
  • Injuries caused by pulling, bolting, escaping, colliding with, knocking down, dragging, or overpowering a person;
  • Falls, fractures, sprains, strains, bruising, cuts, puncture wounds, leash burns, and rope burns;
  • Injury or death involving you, your dog, another person, another dog, another animal, a child, family member, guest, neighbor, bystander, or third party;
  • Dogs escaping, running into traffic, becoming lost, attacking or being attacked by another animal, or otherwise placing themselves or others in danger;
  • Aggravation or escalation of fear, anxiety, aggression, reactivity, prey drive, resource guarding, or other behavioral problems;
  • Injury resulting from use or misuse of leashes, long lines, collars, slip leads, prong collars, electronic collars, crates, place boards, muzzles, harnesses, training equipment, or other tools;
  • Choking, entanglement, equipment failure, improper fit, incorrect timing, excessive or insufficient pressure, or incorrect application of a technique;
  • Illness, physical stress, overheating, dehydration, allergic reactions, aggravation of an existing condition, veterinary emergencies, serious bodily injury, permanent disability, and death; and
  • Property damage caused directly or indirectly by a dog or training activity.

YOU KNOWINGLY AND VOLUNTARILY ASSUME ALL RISKS associated with participating in or applying the Training Materials, whether such risks are known or unknown, foreseeable or unforeseeable, inherent in dog training, or arising from the conduct of you, your dog, other persons, other animals, or, to the fullest extent permitted by law, the ordinary negligence of a Released Party.

5. USER RESPONSIBILITY AND DUTY TO TRAIN SAFELY

You are responsible at all times for your own safety, your dog's safety, and the safety of every person and animal who may be affected by your dog or your training activities. You agree to use reasonable judgment; consider your dog's size, strength, age, temperament, medical condition, training history, bite history, aggression, reactivity, fear, prey drive, triggers, and known behavioral issues; use properly fitted and maintained equipment; train in an environment reasonably suited to the exercise; maintain physical control whenever necessary for safety; prevent third parties or other animals from entering unsafe situations; follow prerequisites, warnings, and recommended progressions; and avoid advancing to techniques for which you or your dog are not prepared.

You must immediately stop or modify an exercise if you cannot safely control your dog, your dog displays dangerous or escalating behavior, equipment is not functioning properly, or circumstances become unsafe. You should seek qualified in-person professional assistance when a situation exceeds your experience, physical capability, or ability to safely control the dog.

You are responsible for complying with all applicable laws, ordinances, leash requirements, animal-control requirements, equipment restrictions, and other rules applicable where you live or train.

6. HEALTH AND VETERINARY RESPONSIBILITY

DIYK9® does not provide veterinary care, medical diagnosis, veterinary behavioral diagnosis, or medical advice. You are responsible for determining whether your dog is physically and medically capable of participating in training. If your dog has a known or suspected injury, illness, pain condition, neurological condition, respiratory problem, orthopedic condition, cardiovascular condition, pregnancy, medication issue, or other medical concern, consult an appropriately licensed veterinarian before beginning or continuing training. Nothing in the Training Materials should be interpreted as directing you to disregard veterinary advice or delay necessary veterinary or emergency care.

7. RELEASE AND WAIVER OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, YOU, ON BEHALF OF YOURSELF AND ANYONE CLAIMING THROUGH YOU, RELEASE, WAIVE, AND DISCHARGE THE RELEASED PARTIES from claims, demands, causes of action, liabilities, damages, losses, or expenses arising out of or relating to your use of or reliance upon the Training Materials; your participation in dog training; your use of any training technique, exercise, method, tool, or equipment; the conduct or behavior of your dog; personal injury, bodily injury, disability, death, veterinary injury, injury or death of an animal, or property damage occurring during or relating to training; or any inherent or foreseeable risk associated with owning, handling, or training a dog.

THIS RELEASE EXPRESSLY INCLUDES CLAIMS ALLEGING ORDINARY NEGLIGENCE BY ANY RELEASED PARTY, including alleged negligent instruction, failure to warn, failure to identify a risk, or other ordinary negligence, to the fullest extent such claims may lawfully be released. Nothing in these Terms is intended to release liability that applicable law does not permit the parties to release.

8. THIRD-PARTY INJURIES, ANIMAL INJURIES, AND PROPERTY DAMAGE

You remain legally and financially responsible for your dog and for the consequences of your decision to participate in dog training. DIYK9® does not assume custody, possession, control, or responsibility for your dog merely because you purchased, watched, accessed, or followed Training Materials.

You are responsible for claims arising from your dog injuring or threatening another person or animal, escaping, damaging property, violating applicable law, or otherwise causing loss or damage while under your ownership, possession, supervision, or control. This includes incidents involving family members, children, guests, neighbors, visitors, members of the public, other dog owners, other dogs, livestock, pets, and other third parties.

9. INDEMNIFICATION

To the fullest extent permitted by applicable law, you agree to defend, indemnify, and hold harmless the Released Parties from and against third-party claims, actions, liabilities, judgments, settlements, damages, fines, penalties, costs, and reasonable attorneys' fees arising out of or relating to:

  • The conduct, behavior, ownership, possession, handling, or training of your dog;
  • Injury or damage caused by your dog;
  • Your performance or attempted performance of a training exercise;
  • Your use or misuse of training tools or equipment;
  • Your failure to follow safety instructions, warnings, prerequisites, or applicable law;
  • Your acts or omissions in connection with your dog or training activities; or
  • Your breach of these Terms.

To the fullest extent permitted by applicable law, this indemnification applies where your conduct, your dog, or your breach contributed to the claim, even if a third party also alleges ordinary negligence by a Released Party. You are not required to indemnify a Released Party to the extent a final non-appealable judgment determines that the loss resulted solely from conduct for which indemnification is prohibited by applicable law.

10. NO GUARANTEE OF TRAINING RESULTS OR SAFETY

DIYK9® does not guarantee any particular training, behavioral, obedience, safety, health, or performance result. Results vary significantly depending on the dog, owner, handler, consistency of training, environment, timing, experience, equipment, health, genetics, prior learning history, behavior, and factors outside DIYK9®'s control.

Past results, demonstrations, testimonials, case studies, before-and-after examples, trained dogs shown in Training Materials, or results achieved by DIYK9® trainers or customers do not guarantee that you or your dog will obtain the same or similar results. Dog training does not eliminate the possibility that a dog may disobey, regress, escape, bite, attack, become reactive, act unpredictably, or cause injury or property damage. A dog described as "trained," "obedient," "reliable," "off-leash trained," or similar terminology remains an animal capable of independent and unpredictable behavior.

11. DISCLAIMER OF WARRANTIES

To the fullest extent permitted by law, the Site, Training Materials, courses, memberships, communities, videos, written materials, and related content are provided on an "AS IS" and "AS AVAILABLE" basis. DIYK9® disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, completeness, safety, suitability, or results, except to the extent such warranties cannot lawfully be disclaimed.

12. LIMITATION OF LIABILITY AND DAMAGES

TO THE FULLEST EXTENT PERMITTED BY LAW, THE RELEASED PARTIES SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, including lost profits, lost business, loss of data, loss of use, or similar economic damages arising from or relating to the Site, Training Materials, services, or your participation in dog training.

For any monetary claim that is not otherwise released under these Terms, the aggregate liability of the Released Parties shall not exceed the amount you paid to DIYK9® for the specific product or service giving rise to the claim, to the extent such limitation is permitted by law. Nothing in this provision limits liability where such limitation is prohibited by applicable law.

13. INTELLECTUAL PROPERTY; LIMITED LICENSE

All content available through DIYK9®, including information, articles, data, software, photographs, graphics, videos, audio, courses, lesson structure, written materials, downloads, logos, slogans, trademarks, and other materials ("Content"), is owned by or licensed to DIYK9®, American Standard Dog Training, or their applicable licensors and is protected by intellectual-property laws.

Subject to your compliance with these Terms, DIYK9® grants you a limited, personal, non-exclusive, non-transferable, revocable license to access purchased Content for your own non-commercial use. You may not reproduce, copy, record, download except where expressly enabled, republish, transmit, distribute, sell, sublicense, publicly display, publicly perform, create derivative works from, share login credentials for, scrape, train artificial-intelligence systems on, or commercially exploit Content without prior written permission.

14. ACCOUNT SECURITY AND ACCEPTABLE USE

You are responsible for maintaining the confidentiality of your account credentials and for all activity occurring through your account. You may not share your account credentials with another person.

A parent or legal guardian may permit a minor to view or participate in appropriate Training Materials under the adult's direct supervision as permitted by these Terms, but the minor may not independently access or operate the account and may not access or participate in any DIYK9® community.

You may not interfere with the Site or platform; attempt unauthorized access; introduce malware; impersonate another person; engage in fraud; scrape or harvest data; violate another person's privacy or intellectual-property rights; upload unlawful, threatening, harassing, defamatory, obscene, infringing, or harmful material; or use the platform for unauthorized commercial solicitation.

15. COMMUNITY, COMMENTS, SUPPORT, AND PRIVATE CONTACT

DIYK9® community access, posting, commenting, direct messaging, community-based support, and other community participation are strictly limited to individuals eighteen (18) years of age or older. Community areas and course comments are intended to clarify educational content and facilitate constructive discussion. They are not a substitute for an in-person assessment and do not create a trainer-client, veterinary, medical, or other professional relationship.

Users must review applicable course material before submitting questions and keep comments reasonably related to the lesson or community topic. DIYK9® may moderate, edit, restrict, hide, or remove content and may suspend commenting or community privileges where activity is excessive, repetitive, unsafe, off-topic, abusive, inappropriate, or inconsistent with the educational purpose of the platform.

Customers and members may not privately contact Academy students, graduates, moderators, administrators, or trainers for training advice unless DIYK9® expressly authorizes that communication channel. Training-related inquiries must be submitted through designated channels. Technical, logistical, billing, or product-related inquiries may be directed to [email protected].

DIYK9® may decline to provide online training advice where, in its judgment, the situation presents a material safety risk, requires in-person evaluation, concerns a minor participating in a high-risk training situation, or exceeds the appropriate scope of online education. DIYK9® does not provide community-based or private training support directly to persons under 18.

16. USER-GENERATED CONTENT

If you submit comments, questions, photographs, videos, testimonials, training footage, or other materials ("User Content"), you represent and warrant that you have the right to submit them; that doing so does not violate another person's privacy, publicity, intellectual-property, contractual, or other rights; and that you have obtained any permission or consent necessary from every identifiable person appearing in or referenced by the User Content. You remain responsible for your User Content.

By submitting User Content, you expressly grant DIYK9®, LLC and American Standard Dog Training, LLC a non-exclusive, worldwide, royalty-free, fully paid, sublicensable, transferable, perpetual license to host, store, reproduce, edit, crop, excerpt, adapt, publish, distribute, publicly display, publicly perform, repost, and otherwise use the User Content, including any names, usernames, voices, images, likenesses, testimonials, statements, and depictions contained in it, in connection with the operation, education, publicity, advertising, marketing, promotion, and other commercial activities of DIYK9® and American Standard Dog Training, in any media now known or later developed, without further notice, approval, or compensation, except where prohibited by applicable law.

To the extent User Content is used as an endorsement or testimonial, DIYK9® may edit it for length, formatting, or presentation but will not materially distort the meaning of the user's stated experience.

Do not upload User Content identifying or depicting a minor unless you are the minor's parent or legal guardian or otherwise have lawful authority to provide the content. By submitting User Content depicting or identifying a minor, you represent and warrant that you have authority to consent on the minor's behalf and expressly consent, on behalf of the minor, to the uses described in this Section, including commercial, advertising, marketing, promotional, and social-media use, to the fullest extent permitted by applicable law. All such submissions must also comply with our Privacy Policy.

17. PAYMENT TERMS; RECURRING BILLING

DIYK9® accepts payment through third-party payment processors. By providing a payment method, you authorize applicable charges for the product or service selected. Monthly memberships automatically renew every one (1) month and annual memberships automatically renew every twelve (12) months unless canceled before the applicable renewal date.

Renewal charges will be made to the payment method on file at the price disclosed at checkout or at a renewal price communicated in advance as required by applicable law. DIYK9® will provide an online cancellation method that is no more burdensome than the method used to enter into the membership.

Where applicable law requires advance notice of an annual automatic renewal, DIYK9® will provide the required written or electronic reminder within the legally required period. Failed payments may be retried, and access may be suspended until amounts due are paid.

You are responsible for reviewing the price, billing frequency, renewal terms, and product description displayed at checkout before purchase. Taxes may be added where required by law.

18. REFUND AND CANCELLATION POLICY

Digital Products - Courses, Bundles, and Videos

Unless a different refund policy is clearly disclosed on the applicable sales or checkout page before purchase, standalone DIYK9® courses, course bundles, and individual training videos purchased directly from DIYK9® are covered by a 7-day money-back guarantee beginning at the time of purchase.

To request a refund, you must contact DIYK9® within that 7-day period. We generally honor timely refund requests without requiring you to provide a reason.

DIYK9® reserves the right to deny or limit a refund where we reasonably determine that the refund policy is being abused or misused, including suspected fraud, repeated purchases and refund requests, chargeback abuse, attempts to obtain or retain substantial course content without payment, violations of these Terms, or other circumstances that reasonably indicate misuse of the refund policy.

Any decision to deny or limit a refund will be made in good faith and in accordance with applicable law. Approved refunds will be returned to the original method of payment, generally within 5-10 business days.

Refunds are not available after the applicable refund period except where required by law. This policy does not apply to memberships, Academy programs, live events, in-person services, or other products or services that have a separate refund policy.

Membership Products - Foundation, Control, and Elite

Memberships include a 7-day money-back guarantee from the time of initial purchase unless otherwise disclosed at checkout. If you cancel within that refund window and receive a refund, access may end immediately.

After the refund window, a recurring membership may be canceled at any time before the next renewal date through the online cancellation method made available by DIYK9®. Cancellation stops future renewal charges but does not ordinarily generate a prorated refund for the current billing period, and access ordinarily continues through the end of the already-paid billing period unless otherwise stated or required by law.

Chargebacks and Payment Disputes

If you initiate a chargeback or payment dispute, DIYK9® may suspend or revoke access to the disputed product or account while the dispute is pending. You agree to contact DIYK9® first and make a good-faith effort to resolve billing concerns before initiating a chargeback, except where applicable law gives you a non-waivable right to dispute a charge.

American Standard Dog Training In-Person Services

Board-and-train, private training, boarding, or other in-person services provided by American Standard Dog Training, LLC are governed by the applicable service agreement and payment terms presented for those services. If a separate signed agreement conflicts with these online Terms concerning an in-person service, the separate signed agreement controls for that service.

Live Seminars and In-Person Events

Unless otherwise stated in writing, event payments and deposits are non-refundable. If DIYK9® cancels or materially reschedules an event, DIYK9® may provide a reschedule, credit, or refund as appropriate. Recordings, copying, filming, or distribution of event content are prohibited without written permission.

Academy and Academy Prep

Deposits toward Academy or Academy Prep enrollment are non-refundable unless otherwise required by law or expressly stated in writing. Tuition terms, completion requirements, graduation standards, financing terms, and any additional refund rights are governed by the enrollment agreement applicable to that program.

19. COURSE ACCESS AND SUPPORT

For purposes of these Terms, "Lifetime Access" means access to purchased standalone course or bundle content for the lifetime of the applicable DIYK9® product while DIYK9® continues to operate and make that product, or a substantially equivalent successor version of that product, available through a platform it controls or uses.

Lifetime Access does not mean the biological lifetime of the purchaser, does not guarantee perpetual hosting on any specific third-party platform, and does not require DIYK9® to remain in business or maintain any particular technology indefinitely. DIYK9® may migrate, reorganize, update, or replace the platform or course delivery method while preserving substantially equivalent access where reasonably practicable.

DIYK9® may update, reorganize, replace, or retire lessons, features, or platform functionality as products evolve, provided that we do not intentionally deprive customers of the material benefit of a paid product without a reasonable substitute where one is appropriate.

Support periods, including access to course comments, live Q&A, communities, or coaching, may be limited by the product purchased and are separate from content access. Community access, community comments, direct messaging, and other community-based support features are strictly limited to individuals eighteen (18) years of age or older. Current support entitlements are described on the applicable sales or checkout page.

20. THIRD-PARTY SERVICES AND LINKS

The Site and Training Materials may use or link to third-party websites, software, payment processors, communities, products, equipment manufacturers, retailers, or services. DIYK9® does not control third-party services and is not responsible for their content, security, availability, terms, privacy practices, products, or conduct. A link or reference does not necessarily constitute sponsorship or endorsement.

21. SMS, EMAIL, AND ELECTRONIC COMMUNICATIONS

If you separately opt in to marketing SMS or email, DIYK9® may send promotional communications, offers, event notices, and product announcements consistent with applicable law and your consent. Transactional or service communications may be sent as necessary to administer your account or purchase.

For SMS, message frequency varies and message/data rates may apply. You may opt out of marketing SMS by replying STOP and may seek assistance by replying HELP or contacting [email protected]. SMS marketing is intended for persons 18 or older. Carrier delivery is outside DIYK9®'s control.

By using our Site or purchasing electronically, you consent to receive agreements, disclosures, notices, receipts, and other records electronically to the extent permitted by law.

22. PRIVACY

Our collection, use, storage, and disclosure of personal information is described in our Privacy Policy, which is incorporated into these Terms by reference. Where these Terms and the Privacy Policy address different subjects, each applies to its respective subject matter.

DIYK9® community participation is not offered to persons under 18. If you believe a minor has created or operated a community account or provided personal information contrary to our policies, contact [email protected].

23. SUSPENSION AND TERMINATION

DIYK9® may suspend or terminate account access, community privileges, support access, or use of the Site where you violate these Terms, misuse the platform, engage in fraud or unlawful activity, create material safety concerns, threaten or harass others, infringe intellectual property, improperly share access, allow a person under 18 to access or participate in the community, or fail to pay amounts due.

Where appropriate, DIYK9® may provide notice or an opportunity to cure, but immediate action may be taken where reasonably necessary to protect safety, security, intellectual property, the community, or the business.

Termination for violation of these Terms may result in loss of access without refund to the extent permitted by law.

24. INFORMAL DISPUTE RESOLUTION

Before filing arbitration or litigation, you and DIYK9® agree to make a good-faith attempt to resolve the dispute informally. The party asserting a claim must send written notice describing the claimant, the nature and factual basis of the dispute, and the relief requested.

Notice to DIYK9® must be sent to [email protected] and by mail to DIYK9®, LLC, 411 Walnut Street #22190, Green Cove Springs, FL 32043. The parties will allow at least thirty (30) days after receipt of notice to attempt resolution before commencing a formal proceeding, unless immediate injunctive relief is reasonably necessary.

25. BINDING INDIVIDUAL ARBITRATION AND CLASS-ACTION WAIVER

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.

Except for claims eligible for small-claims court, claims seeking temporary or preliminary injunctive relief to protect intellectual property, confidentiality, security, or safety, and claims that applicable law prohibits from arbitration, any dispute, claim, or controversy arising out of or relating to these Terms, the Site, Training Materials, membership, community, purchase, or relationship between you and DIYK9® shall be resolved by binding individual arbitration and not by a judge or jury.

The Federal Arbitration Act governs the interpretation and enforcement of this arbitration agreement. Arbitration shall be administered by JAMS pursuant to the JAMS rules applicable to consumer disputes and the JAMS Consumer Arbitration Minimum Standards then in effect. If there is a conflict between another JAMS rule and the Consumer Arbitration Minimum Standards, the Consumer Arbitration Minimum Standards will control to the extent applicable.

Arbitration will proceed on an individual basis and may be conducted remotely or in Clay County, Florida, except where applicable law or JAMS requirements provide for another location or procedure. Arbitration fees and costs will be allocated as required by the applicable JAMS rules and Consumer Arbitration Minimum Standards.

YOU AND DIYK9® AGREE THAT EACH MAY BRING CLAIMS ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF, CLASS MEMBER, OR REPRESENTATIVE IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, MASS, OR REPRESENTATIVE ACTION, to the fullest extent permitted by law. The arbitrator may award relief only to the individual claimant and only to the extent necessary to resolve that claimant's individual claim.

You may opt out of this arbitration agreement by sending written notice to [email protected] within thirty (30) days after the date you first accept Terms containing this arbitration provision. Your opt-out notice must include your full name, the email associated with your account, and a clear statement that you are opting out of the arbitration provision. Opting out of arbitration does not affect the remaining Terms.

26. GOVERNING LAW AND COURT VENUE

These Terms and any dispute not required to be arbitrated shall be governed by and construed in accordance with the laws of the State of Florida, without regard to conflict-of-laws principles, except where federal law governs a particular issue or applicable law provides a non-waivable consumer protection.

DIYK9®, LLC is a Florida limited liability company with business operations in Florida and North Carolina. The parties agree that Florida has a substantial and reasonable relationship to these Terms and the transactions governed by them.

Except for matters required to be arbitrated and to the fullest extent permitted by law, any lawsuit, action, or proceeding arising out of or relating to these Terms or the relationship between you and DIYK9®, LLC shall be brought exclusively in the state courts located in Clay County, Florida, or, where federal subject-matter jurisdiction exists, in the United States District Court for the Middle District of Florida, Jacksonville Division. You consent to those courts and waive objections based on improper venue or inconvenient forum to the fullest extent permitted by law.

27. FORCE MAJEURE

DIYK9® is not liable for delay or failure to perform caused by circumstances beyond its reasonable control, including severe weather, natural disasters, fire, war, terrorism, civil unrest, government action, public-health emergencies, labor disputes, utility failures, platform or internet outages, cyber incidents, or failures of third-party service providers.

28. CHANGES TO THESE TERMS

DIYK9® may update these Terms as its products, laws, or business practices evolve. Material changes will apply prospectively to the extent required by law. Where a change materially affects existing contractual rights, DIYK9® may provide notice and, when appropriate, require affirmative acceptance before the updated term applies to an existing customer.

The version presented and accepted at the time of purchase or later affirmative acceptance governs to the extent required by law. Continued use alone will not be treated as replacing a prior agreement where applicable law requires clearer assent.

29. SEVERABILITY; WAIVER; ASSIGNMENT; ENTIRE AGREEMENT

If any provision of these Terms is held invalid or unenforceable, it will be enforced to the maximum extent permitted and the remaining provisions will remain in effect, except where the invalid provision is essential to a specific arbitration or class-waiver mechanism and applicable law requires a different result.

DIYK9®'s failure to enforce a provision is not a waiver. You may not assign your rights or obligations under these Terms without DIYK9®'s written consent. DIYK9® may assign these Terms in connection with a merger, acquisition, reorganization, sale of assets, or transfer of the applicable business.

These Terms, the Privacy Policy, applicable checkout disclosures, and any product-specific agreement presented and accepted by you constitute the agreement between you and DIYK9® concerning the subject matter they cover. If a separately signed agreement expressly conflicts with these Terms for a specific service, the separately signed agreement controls for that service.

Provisions that by their nature should survive termination, cancellation, expiration, or suspension of these Terms or your account will survive, including provisions relating to intellectual property, assumption of risk, releases and waivers, indemnification, limitations of liability, User Content licenses, payment obligations, dispute resolution, arbitration, governing law, and venue.

31. FINAL ACKNOWLEDGMENT OF RISK AND RESPONSIBILITY

BY PURCHASING, ACCESSING, WATCHING, USING, OR PARTICIPATING IN THE TRAINING MATERIALS, YOU ACKNOWLEDGE THAT DOG TRAINING CAN RESULT IN SERIOUS INJURY, PERMANENT INJURY, PROPERTY DAMAGE, INJURY OR DEATH OF AN ANIMAL, AND, IN EXTREME CIRCUMSTANCES, DEATH OF A PERSON.

You acknowledge that no dog-training method can eliminate all risk and that dogs may behave unpredictably even when training is performed correctly. You voluntarily accept these risks and accept responsibility for determining whether and how to participate in any training activity.
